Understanding Ontario’s Employment Standards Act: Essential Resources for Small Businesses

A helpful guide for Ontario employers to understand their responsibilities and stay compliant with employment standards.

Running a small business comes with many responsibilities, including understanding and meeting employment standards requirements. Ontario’s Employment Standards Act, 2000 (ESA) establishes minimum standards for most workplaces, helping employers understand their legal obligations and protecting employees’ workplace rights.

To support small businesses, the Ontario government has developed helpful tools and resources to make it easier for employers to understand their responsibilities and comply with employment standards legislation.

What Small Businesses Need to Know

Under the ESA, most employers in Ontario must follow minimum employment standards covering areas such as:

  • Minimum wage and payment of wages โ€“ Understanding wage requirements, pay statements and permissible deductions.
  • Hours of work and overtime โ€“ Following rules regarding working hours, breaks and overtime pay.
  • Public holidays and vacation โ€“ Meeting requirements for holiday entitlements, vacation time and vacation pay.
  • Leaves of absence โ€“ Understanding employees’ rights to job-protected leaves.
  • Termination of employment โ€“ Following applicable notice and termination pay requirements.

Certain rules, exemptions and special provisions may apply depending on the industry, position or type of employment.

Employers can review the Employment Standards Act, 2000 to learn more.
